Nakamura v Home Office: Indefinite Leave to Remain

Immigration Law ILR Granted

Our client, a Japanese national who had lived and worked lawfully in the UK for over a decade, had her application for Indefinite Leave to Remain refused three times by the Home Office on the grounds of an alleged gap in lawful residence. We identified that the refusals were based on a misapplication of the Immigration Rules and applied for a statutory review. Our judicial review application succeeded in the Upper Tribunal, which found in favour of our client. ILR was granted within 28 days of the judgment.
